The European Union imposes record-breaking fine on Meta

In a groundbreaking move, the European Union (EU) has imposed a record-breaking fine on Meta, the parent company of Facebook. The transfer of user data to the United States without proper consent or safeguards is a violation of the European General Data Protection Regulation (GDPR).

The EU has long been at the forefront of protecting individuals' rights to privacy and enforcing strict rules on the transfer of personal data outside its territory. The General Data Protection Regulation (GDPR), which came into force in 2018, empowers the EU to take decisive action against companies that fail to comply with its data protection standards. The DPC has now given Meta five months to stop data transfers to the US.

By imposing this fine on Meta, the Irish Data Protection Commission (DPC) is sending a clear message that it will not tolerate the misuse of user data by tech giants. The amount of the fine reflects the seriousness of the violation and is intended to serve as a deterrent to other companies. “Too big to fail” is a clear signal to all other companies to review their data transfers. The fine also underscores ongoing concerns about data transfers between the EU and the US, particularly in light of the European Court of Justice's Schrems II ruling.

As Meta faces the consequences of its actions, it serves as a wake-up call for other technology companies to prioritize data protection and compliance. Meta announced that it would appeal and did not announce any restrictions for users in Europe on the use of Facebook, Instagram, or WhatsApp.

The outcome of the appeal will take a long time, so it is crucial for companies to draw the right conclusions and review their own communication channels:

  • Are the captchas used compliant with data protection regulations?
  • Are consent managers such as Cookiebot and Usercentrics complete and up to date?
  • What is the status of AV contracts with suppliers?
  • Are my communication channels still the right ones? Are target groups being addressed in a GDPR-compliant manner? Are there other channels, such as LinkedIn, that are more suitable than Instagram?
