ECJ ruling: Cookie regulation stipulates obligation for consent banners and detailed information.
On October 1, 2019, the European Court of Justice expressly required cookie consent in its ruling. Since then, cookies that are not absolutely necessary may not be set automatically.
However, cookies are still permitted. A distinction can be made between necessary, functional, and marketing cookies.
The user must actively select the functional and marketing cookies and consent to their use via individual containers.
- Necessary cookies are required to use the website and its services. These are essential cookies.
- The functional first-party analytics cookies, also known as statistics cookies, do not collect personal data, but are often used to improve the performance of the website. These must be activated by the user.
- Marketing cookies, such as preference, performance, and functionality cookies for advertising and social media, are inactive and must first be activated by the user via a checkbox.
The ruling simply means that user data belongs to the user, who will actively determine what happens to it in the future. It is certainly possible that fewer cookies will now be set and that the personalization of ads will become more difficult.
